I am curious if anybody has sold-on an apartment in Warclaw yet? Did you need the notarial deeds to be assigned to you first and how long did it take after completion of the building?

I bought with a view to quick sale. My apt was finished in January 08. To date I have chosen to leave it in its developer finish with a view to selling. The latest date for having the notarial agreement in place is Jan 09. From what I can find out, I can't sell until this is in place. Am I correct?

i believe this is the case .I have a similar problem with a unit in warsaw.I want to sell it on black finish, but due to a loan offer of 80,not 90% I have a shortfall.I need to put in an extra 10%,wait for it to be registered with the land registry(1 year)? then I can sell it! So that is an extra 20k in,approx 12 months of mortgage payments to sell at a miniscule profit.I bought this as a long term rental investment,but did not factor in such a shortfall and a shift in the currency.

sorry got a bit carried away!!!!!!!
Unless the contract can be reassigned,It just doesnot stack as a flipping market.

Hi All,

Is this notarial procedure common to all Polish property and does it normally take around a year to complete?

I'm intending to sell a Krakow apartment next spring when it completes, but are you saying that this isn't possible immediately after completion?

Just to update - I've done a little digging and from an earlier forum post (Polish CGT) it seems that the registration process varies from city to city but can be 3, 6, or 12 months.

This isn't good news for me, but it does appear that the sale is agreed at the start of the process and a deposit paid then.

I'll email Stanislaw directly for the situation specifically in Wraclow and Krakow and report back...

It is possible to sell on a property before the transaction has been registered with the Polish court and noted on the deeds - you need to show the notary your purchase contract or preagreement and he will be able to draft the sale contract accordingly. In Krakow it's taken anything between 3 months and a year to get our properties registered, but we have sucessfully bought and sold before this has been completed. It's not necessary to have a final sale agreement either; on one occasion we signed a preagreement on a flat from someone who himself had only a pre-agreement to buy it from the previous owner and then completed the purchase from him once he had completed his purchase.

Hi Ewa, Ben,

Thanks for the feedback - I should have said that I prefer to own the property before sale (and not flip) to avoid the higher taxes associated with flipping if I understand the process correctly.

As I see it the best profit is made by completing then selling, but my concern is this delay on notarisation.

Ewa, your post is very interesting, it seems to me you can go through the agreement process of a sale, but the sale proceeds are only released after registration, is this correct?
