Surely you cannot use your apartment as your registered address as it is incomplete and your contract is Cadastre Vires? So it is actually void. There seems to be a lot of foreign investors purchasing of plan with not knowing the full extent of what the consequences my be.

Also Does it not cost between 1500-2000 Euro`s to dissolve a company on top accountants fees of around 600-800 Euro`s. A higher Council Tax to pay, And 16% on top of your 16% income tax to take the money out of the business.

Buying in a company sounds like a lot of headache and especially if you wasting your time as your contract may be void. My biggest concern is if I by in My name will I have problems with resale due to the fact that I do not own a share of the land?

That's why I suggest putting the apartment in your own name - this will probably be about 90% of the overall property value. Also if you buy property in company name it is almost impossible to get a mortgage.

I set up a company for owning the land as I am spending Euro 1m + but I agree if you are buying a flat for Euro 100k it is best to avoid a company completely and have the developer put the land in an SPV, if he agrees to it.

Bulbasaurus - You seem to have a good knowledge of how things work in Romania, Hope you don`t mind me asking are you purely an investor or are you an agent?

Are SPV some sort of trust? And are they watertight safe? Would I have any problems in resale if I Put the apartment in my name and the land in a company name? I am looking to buy around 3 units and was wondering if I could buy a run down house in the middle of nowhere for say 15,000 Euro`s and have this as my registered address? Could you recommend a good lawyer.
