| Bulgaria off plan development 2 years late can i get a refund |

I bought a ski chalet in Bulgaria back in 2005 with a written guarantee from a reputable Uk developer that it would be completed by December 2006, now nearly 2 years later and no sign of completion yet, how do i stand on requesting a refund, what would be the best way to approach it. Rob

Good Luck Rob! I bought a ski chalet in Bansko with a clause in the contract that I would get a full refund if construction was delayed gretaer than 2 months. Having activated the clause 10 months ago I have only just got my money back. I had many sleepless nights and really felt I would have to take legal action which according to my lawyer could take up to 9 years to get my money back! Fortunately, I was successful by being patient and persevering. Unfortunately, an ex-colleague of mine whom also bought in the same complex still hasn't got his money back yet!

Good to hear that you get your money back Shadwell. I also experienced this and sad to say I’m still hoping that I’ll get my money back, it’s been almost 1 year since the date of completion but still there’s no sign of completed project. I don’t know what to do but I already gave the written contract to my lawyer to study it; we’re going to take legal actions and I am hoping that my money will be refunded.

Shadwell I'll keep on at them and see what happens, i also gave a copy of the contract to my lawyer to see where i stand. Hopefully hear something soon !! Rob

Rob I eventually had to threaten the developer with seriously bad publicity if the funds were not forthcoming by a certain date. I'd had lots of broken promises where they had promised to refund me but come deadline day I hadn't received any funds. As a last resort (needs must!), I decided to fabricate a story that I was related to a high profile national newspaper editor in the UK who was happy to use my story to illustrate ongoing corruption in Bulgaria. I asked my lawyer to send a letter to this effect and lo and behold the funds turned up within about 2 weeks! Good luck!
