Thank you for your post. PS are happy to look into the situation, if you would like to forward your complaint to the Legal & Business Affairs department then we will look at this on behalf of any purchaser.

Property Secrets take any concern raised by client's seriously and if there is something that we can do to assist the client then we will do our best.

Thank you Debbie. I appreciate your offer, but this has been raised with PS staff several times already, with no results. Each time I have been told the query would be passed to the Legal & Business Affairs dept, but there has been no response, despite the issue being chased up. We are now resolving it with a new lawyer, who will no doubt be in contact with the PS-appointed lawyer.

How strange! The issue (lack of communication and co-operation from the PS purchase lawyer) was raised, by email, on the 7 September 2007, and then again on the 30 November 2007, both times acknowledged by PS employees, giving assurances it would be investigated. It was followed up by telephone, but I was told there was 'no chance' that it could or would be dealt with, and this is why we are now speaking to a new lawyer in Nicosia.

I don't understand your term' as a purchaser within Cyprus' - could you clarify?

It appears there are other purchasers with issues relating to this particular purchase lawyer, so perhaps your attention could be turned to them, as we now have our own solution to this problem. Thank you for your time and trouble though.

It may be helpful Helen to read the reply I got from Deborah in March 07 regarding several complaints I made to PS re the Avlida development. It could help all clients to understand exactly where they stand when things go wrong at completion. Please note that I got this 6 1/2 weeks after my first complaint. The size of our apartment in the Investment report is the same as the Contract at Exchange, but what was delivered is 10m2 less. So what was delivered was not what was contracted for - the method of not having representation at Completion from the Solicitor who drew up that contract is in my view utterly ridiculous and was certainly not fully understood by Avlida purchasers as I discovered.

Fair enough, but perhaps you should explain exactly where Clients stand at Completion on their purchases through Property Secrets as clearly as you explained it to me in that email because I had a significant number of Avlida owners tell me that they thought the Solicitor represented them right through to Completion.

If Clients understood fully that the money they paid for legal services left them with no legal representation after Exchange of Contracts they might think again about how this will work - it doesn't work, as we found out and were left wondering why Solicitors and Property Secrets were failing to respond adequately to our complaints.

There are clearly still a number of clients who don't understand this fully.

This is exactly the position I was left in on my Palace Heights purchase. After exchange the solicitor simply stopped responding to mails or returning telephone calls. The next payment request came direct from a developer with whom I had had no previous contact with or handover to. It was only after reading Helen's post that I became aware I might be suffering the same problem as savvy and others did on earlier investments.

Looking back at the investment report and other documentation, I paid for a solicitor to represent me during the purchase, surely in plain English that means up to the delivery/acceptance of my apartment.

I am now in the position of despite paying approx twice the normal cost for conveyancing in Cyprus having no legal representation. This was not explained in any of the documentation and there is no allowance in the purchase price spreadsheet for post exchange legal advice, so I think I am justified in feeling mislead by PS.

From the spreadsheet figures that PS collected £24,000 for negotiating the contract. That leaves me wondering exactly what the purchase lawer did for almost £2000 per unit in taking us up to exchange.

Please can you provide PS's view of the situation and advice about how I should now proceed.

Re Helen's Email address your response appears to be deliberately unhelpful, on many other occasions PS have allowed exchange of contact details.
